JobScreener AI Terms of Service

1. Introduction
This Agreement is made between the individual or entity using JobScreener AI's services ("User") and JobScreener Pty Ltd ("JobScreener," ("JobScreener AI," "we," "us," or "our"). Users may be job seekers ("Candidates") or companies seeking to hire ("Clients").
By accessing or using our services, including our website, mobile applications, and AI-powered recruitment tools (collectively, the "Platform"), you agree to comply with and be bound by the following Terms of Service. Please read them carefully.
2. Definitions
- "Platform" refers to the JobScreener AI website, applications, and services.
- "User" refers to any individual or entity using the Platform.
- "Client" refers to companies or individuals seeking candidates through the Platform.
- "Candidate" refers to individuals seeking employment opportunities through the Platform.
- "AI Analysis" refers to the artificial intelligence-driven assessments, evaluations, and automated processes conducted through the Platform.
- "Content" refers to text, images, audio, video, resumes, job descriptions, and all other forms of data submitted to or through the Platform.
3. Services Provided
JobScreener AI offers AI-powered recruitment services, including but not limited to:
- AI-driven candidate evaluation, matching, and ranking
- Automated resume screening and analysis
- Voice-based AI interviews and analysis
- Interview scheduling and coordination
- Talent pool management for Clients
- Job search and application tools for Candidates
- Skills assessment and gap analysis
- Recruitment workflow automation
4. User Obligations
4.1 All Users agree to:
- Provide accurate and up-to-date information during registration and use of the Platform
- Use the Platform ethically and professionally
- Respect intellectual property rights and confidentiality
- Comply with all applicable laws and regulations, including anti-discrimination and data protection laws
- Not use the Platform for any unlawful, fraudulent, or discriminatory purpose
- Not attempt to circumvent, disable, or interfere with security features of the Platform
4.2 Candidates agree to:
- Provide accurate information regarding their qualifications, experience, and skills
- Participate in automated interviews and assessments in good faith
- Not submit false or misleading information about their background or qualifications
4.3 Clients agree to:
- Use candidate data responsibly and in compliance with applicable laws
- Provide accurate job descriptions and requirements
- Maintain confidentiality of candidate information
- Not use the Platform to discriminate against candidates based on protected characteristics
- Ensure they have proper authorization to post job opportunities and conduct hiring activities
5. JobScreener's Responsibilities
JobScreener commits to:
- Provide high-quality, AI-driven recruitment services
- Maintain the security and privacy of user data
- Continuously improve the platform's algorithms and features
- Implement measures to identify and mitigate algorithmic bias
- Respond to user inquiries and concerns in a timely manner
- Provide reasonable technical support for Platform functionality issues
6. Candidate Ownership and Marketing Communications
6.1 Client-Owned Candidates
Clients retain full ownership rights over their candidate lists submitted to the Platform. JobScreener AI acknowledges that these candidates are owned by the Client and will not directly or indirectly hire or solicit these candidates for employment outside the Platform.
6.2 Marketing Communications
By submitting candidate information to the Platform, Clients grant JobScreener AI permission to engage with these candidates for marketing and communication purposes, including but not limited to:
- Newsletters and platform updates
- Social media messaging
- Information about relevant job openings on the Platform
- Educational content related to job seeking and career development
6.3 Opt-Out Options
All marketing communications sent by JobScreener AI will include clear opt-out options, allowing candidates to unsubscribe from such communications at any time while still maintaining their profile on the Platform.
7. Salary Negotiations and Employment Terms
JobScreener AI does not participate in or facilitate salary negotiations between Clients and Candidates. All compensation discussions, employment terms negotiations, and hiring decisions are conducted independently outside our Platform and are at the full discretion of the Client and Candidate. JobScreener AI makes no representations or warranties regarding salary levels, employment terms, or hiring outcomes.
8. Fees and Payments
8.1 Client Payment Options
Clients agree to pay JobScreener AI in accordance with one of the following payment structures, as selected during registration or as subsequently modified:
- Monthly subscription plan at the rates agreed upon during sign-up
- Per-service recruitment fees as specified on the Platform or in a separate agreement
8.2 Candidates
Candidates will not be charged for using the Platform to seek employment opportunities, unless specifically opted into premium services that may be offered.
8.3 Payment Terms
All fees are exclusive of taxes, which are the Client's responsibility. Payments are due in accordance with the terms specified in the Client agreement or on the Platform. We accept payment via credit card, bank transfer, or other methods as specified on our website. Subscription services may be subject to automatic renewal unless cancelled in accordance with the procedures outlined on the Platform.
9. Data Privacy and Security
9.1 Data Collection and Usage
- Users consent to the collection and use of their data as outlined in our Privacy Policy.
- JobScreener will collect, store, and process user data in compliance with relevant data protection laws including GDPR and CCPA where applicable.
- Users acknowledge that their data may be processed by AI systems to facilitate the services provided by the Platform.
9.2 Security Measures
- JobScreener will implement robust security measures to protect user information.
- While we take reasonable measures to protect your data, no internet transmission is completely secure, and we cannot guarantee absolute security.
9.3 Third-Party Sharing
- Users acknowledge that their data may be shared with third-party services for evaluation and improvement of our services.
- JobScreener will only share user data with explicit consent or as required by law.
10. AI Analysis and Results
10.1 Nature of AI Analysis
You acknowledge that AI Analysis is probabilistic in nature and not deterministic. Results are based on patterns identified by our AI systems and should be considered as recommendations, not definitive assessments.
10.2 Limitations of AI Analysis
You acknowledge that AI Analysis may have limitations, including potential algorithmic biases. We continuously work to identify and mitigate such biases, but we cannot guarantee that the Platform is free from all biases.
10.3 Human Oversight
You agree that AI Analysis should be subject to human oversight and that recruitment decisions should not be made solely based on automated processing without meaningful human review.
11. Voice Analysis and Automated Interviews
11.1 Consent to Voice Analysis
By participating in an automated interview through the Platform, Candidates consent to having their voice recorded and analyzed by our AI systems.
11.2 Purpose of Voice Analysis
Voice analysis is used to assess communication skills, confidence, and other relevant factors for the position. The analysis does not assess protected characteristics such as age, gender, accent, or ethnicity.
11.3 Right to Opt Out
Candidates have the right to opt out of voice analysis features and request alternative assessment methods, though this may limit their profile visibility to certain Clients.
12. Intellectual Property
12.1 Platform Ownership
All content, algorithms, and software on the JobScreener AI Platform are the property of JobScreener and protected by intellectual property laws.
12.2 User Content Licenses
By submitting Content to the Platform, you grant JobScreener a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such Content for the purpose of providing and improving the Platform.
12.3 Restrictions
Users may not copy, modify, distribute, sell, or lease any part of the Platform or its content without explicit permission from JobScreener.
13. Limitation of Liability
13.1 No Guarantees
JobScreener does not guarantee employment for Candidates or successful hires for Clients. The Platform is provided to facilitate the recruitment process, but outcomes depend on many factors outside our control.
13.2 Specific Limitations
JobScreener is not liable for:
- Hiring decisions made by Clients
- Accuracy of information provided by users
- Consequential damages arising from use of the Platform
- Service interruptions or data loss
- Any indirect, special, incidental, or punitive damages
13.3 Liability Cap
In no event shall JobScreener's total liability to you for all claims exceed the amount paid by you, if any, for accessing the Platform during the 12 months preceding the claim.
14. Indemnification
Users agree to indemnify and hold harmless JobScreener AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of or related to their use of the Platform, violation of these Terms, or infringement of any third-party rights.
15. Termination
15.1 Termination by User
Users may terminate their account at any time by following the instructions on the Platform or by contacting us.
15.2 Termination by JobScreener
JobScreener reserves the right to suspend or terminate access to the Platform for any User who violates these Terms of Service or engages in conduct detrimental to the Platform or its Users.
15.3 Effect of Termination
Upon termination, users must cease using JobScreener's services and JobScreener will securely delete user data as per data retention policies. Certain provisions of these Terms will survive termination, including intellectual property rights, limitation of liability, and indemnification.
16. Modification of Terms
JobScreener AI reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on the Platform. Users are responsible for regularly reviewing these Terms. Continued use of the Platform constitutes acceptance of the modified Terms.
17. Fair Use and Anti-Discrimination Policies
17.1 Fair Use Commitment
We are committed to promoting fair use of AI in recruitment processes. This includes designing our algorithms to minimize bias and promoting transparency in how our systems make recommendations.
17.2 Anti-Discrimination Policy
You agree not to use the Platform in a manner that discriminates against candidates based on protected characteristics. We reserve the right to suspend or terminate accounts that violate this policy.
17.3 Algorithmic Transparency
We strive to provide reasonable explanations of how our AI systems generate recommendations and assessments. However, due to the complex nature of AI algorithms, we cannot provide complete explanations of all factors contributing to specific outcomes.
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth State of New South Wales, Australia, without regard to its conflict of law principles.
18.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA). The arbitration shall be conducted in English and shall take place in Sydney, New South Wales, Australia.
18.3 Class Action Waiver
Users agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
19. General Provisions
19.1 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
19.2 Entire Agreement
These Terms constitute the entire agreement between you and JobScreener regarding the Platform and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
19.3 No Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right under these Terms shall not constitute a waiver of such right.
19.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void.
